Digital Evidence in Domestic Core International Crimes Prosecutions

Abstract The conflicts in Syria and Iraq, being some of the most documented history, have also led to one largest influxes refugees Europe recent years. Many asylum seekers arriving European cities identified themselves, or been identified, as victims, witnesses perpetrators atrocities. Consequently, criminal investigations initiated by local police with aim prosecuting those responsible for genocide, war crimes against humanity committed Iraq. With an increasing number prosecutions domestic courts relating atrocities committed, shared returning fighters, authorities are compelled find ways effectively collect, process, analyse share user-generated data. This article discusses which digital evidence related particularly online open source materials, litigated judicially evaluated jurisdictions Germany, Finland, Sweden Netherlands. Finding parallels between these approaches, distilling best practices collection, processing analysis, should inform future international worldwide.
